These Terms of Service ("Terms") govern your use of Mighty, a macOS application developed by Mike Zamagias ("Developer", "I", "me"). By downloading, installing, or using Mighty, you agree to these Terms.
I grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Mighty on your Mac for personal or professional purposes. This license is for your individual use and does not include the right to sublicense, distribute, or share access to the software.
Mighty offers a free tier with basic battery monitoring features. The Pro tier unlocks additional capabilities (DPI control, polling rate, button remapping, multi-device profiles) for a one-time payment of $14.99. There are no subscriptions or recurring charges.
All payments for the Pro tier are processed by Lemon Squeezy, who acts as the Merchant of Record for all Mighty transactions. When you purchase the Pro upgrade, your contract of sale is with Lemon Squeezy, not directly with me. Lemon Squeezy is responsible for billing, fraud screening, payment processing, the collection and remittance of applicable sales tax / VAT / GST, and for compliance with consumer-protection rules in your jurisdiction. By purchasing, you also agree to Lemon Squeezy's Terms of Service and Privacy Policy. Their Merchant-of-Record disclosures are at lemonsqueezy.com/legal/merchant-of-record.
EU VAT & consumer rights. If you are an EU consumer, Lemon Squeezy determines and charges the VAT rate of your country at checkout, issues a VAT-compliant receipt, and remits the tax to the appropriate authority. You have the statutory 14-day right of withdrawal under Directive 2011/83/EU, except that — by completing the Mighty Pro checkout — you expressly request immediate delivery of digital content (your license key) and acknowledge that the right of withdrawal is therefore lost as soon as the license key is issued, in line with Article 16(m) of that directive. The 30-day money-back guarantee described in the Refund Policy applies in addition to, and is more generous than, your statutory rights, and does not waive them.
When you purchase Pro, Lemon Squeezy issues you a license key by email and via the post-purchase landing page. You may activate that key on a reasonable number of personal Macs (currently up to three concurrent activations per key); deactivating a machine inside the app frees up a slot. Activations and deactivations are handled by Lemon Squeezy's license API. I may revoke a license key if it has been refunded, charged back, fraudulently obtained, or shared publicly to circumvent paid use; revocation will deactivate Pro features on the affected machines but will not affect the free tier.

Mighty, including its design, code, and branding, is the intellectual property of Mike Zamagias. These Terms do not transfer any ownership rights to you. All rights not explicitly granted are reserved.
Mighty is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied. I do not warrant that the app will be uninterrupted, error-free, or compatible with all hardware configurations. Use of Mighty is at your own risk.
To the maximum extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising from your use of or inability to use Mighty. My total liability shall not exceed the amount you paid for the Pro tier.
I may terminate or suspend your license at any time if you violate these Terms. Upon termination, you must stop using Mighty and delete all copies. Sections relating to intellectual property, disclaimers, and liability survive termination.
I may update these Terms from time to time. Continued use of Mighty after changes constitutes acceptance of the revised Terms. Significant changes will be communicated through the app or website.
These Terms are governed by the laws of Greece. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Heraklion, Greece.
